Saving Hong Kong’s Harbour

Synopsis

Urban Planning and Environmental Protection – Importance of Hong Kong’s Victoria Harbour; sustainable development; environmental impact assessment; impact of massive reclamation on urban planning, traffic, ecology and the environment; height control of high-rise buildings around the Harbour; planning an accessible and people-friendly harbour-front.

Environmental and Administrative Law – Recent development of environmental law in Hong Kong and other jurisdictions; enactment of the Protection of the Harbour Ordinance as a private member’s bill; enforcement of the Ordinance through the Legislative Council; statutory presumption; interim stay order; costs order on an indemnity basis for charitable organizations; Judgment of the Hong Kong Court of Final Appeal on interpretation of legislation and conduct of judicial reviews.

Public Administration and Governance – Impact of democracy and the rule of law on the political development of Hong Kong since its hand-over to China in 1997; importance of Non-Governmental Organisations (“NGOS”) in environmental protection; formation and administration of the Protection of the Harbour Society; how to organize public support; how NGOS can affect government policy.


About the Speaker

Winston Ka-Sun Chu is a Fellow and Visiting Professor academically affiliated to the Faculty of Laws and the Bartlett School of the Built Environment of University College London and also an Honorary Lecturer of the Law Faculty of The University of Hong Kong.  He was a member of the Town Planning Board, Metro Planning Committee and Lands and Buildings Advisory Committee of the Hong Kong Government.  He was the Founder and Chairman of the Society for Protection of the Harbour and undertook a ten-year public and legal campaign to save Hong Kong’s world-famous Victoria Harbour from destruction through excessive reclamation.  He was responsible for the enactment of the Protection of the Harbour Ordinance and in securing the recent decision of the Hong Kong Court of Final Appeal in the interpretation and enforcement of the Ordinance.
